Interview With the Pain Doctor

Interview with Dr. Darrow By attorney Michael Ehline – As part of my commitment to chasing solutions for injury victims, rather than attorney’s fees, I like to bring things to the forefront that should REALLY matter to those adversely harmed by the negligence of others. One common theme we accident attorneys see with big injuries, is the need for long term pain management. Managing pain can mean the difference between normal human function, and constant discomfort. But did you know there are also many ways to heal the body by using your own blood, stem cells, and even by causing the body to regenerate its own tissue by creating a proliferation in the damage location? Surgery is not always the best option when, with these new and...

Government Overreach, Hurting Doctors & Proposition 46

California faced an important ballot initiative this year. As many victims of med mal know, there is an artificial cap on the amount that victims of medical malpractice can recover in lawsuits. Unfortunately for the same insurance companies that drafted the ACA for the Obama admin, if this Proposition 46 had passed, it would have stopped the process where the suffering of victims are being artificially capped by arbitrary standards, rather than the actual effects of what had happened to them, as it was under common law. Having a pain and suffering standard of $250,000 in claims is based on a 1970s era formula that has not been raised in nearly forty years has virtually gutted the med mal law field. Beyond this, this amount has not kept track...

Determining Liability in a Defective Motorcycle Accident Claim

Bikers like to ride in groupsUsually, motorcycle accidents are caused by things like careless driving (by the biker or another motorist) or road conditions. More rarely, accidents are caused by some defect in the motorcycle or one or more of its component parts. Understanding Product Liability Law Product liability law is a branch of tort law that deals with defective products. Products can be defective in several ways: They can be inherently dangerous (have a dangerous design). They can be defectively manufactured. The manufacturer may fail to warn of known risks so that users can take precautions to avoid injuries. When a motorcycle has a dangerous design, or a defect, the manufacturer may be liable for any injuries caused by accidents...

Tracy Morgan and The Seatbelt Defense

By attorney Michael Ehline – One of my favorite comedians besides Dave Chapelle is definitely actor Tracy Morgan. Morgan was recently severely hurt in a collision with a Walmart tractor trailer truck as a passenger in his limo bus, and he may not return to acting any time soon. According to Morgan’s attorney Benedict Morelli, the 45 year old actor and comedian suffered a brain injury and other harm in the June 7, 2014 crash. The lawyer stated that the doctors are not certain with the outcome of Morgan’s injuries, and he has been in physical and vocational therapy. He is working on cognitive and speech issues. Morgan is currently still using a wheel chair and the attorney said he was still struggling with the injuries caused during...

Fake Cosmetic Surgeons, Legal and Other Malpractice Claims

Cosmetic surgery has become a hot medical resource in recent years and changed the way medicine is developing in this area. What it has also done is change the medical professional specializing in these areas to exceptionally skilled and trained plastic surgeons, that are board certified. Now other physicians and medical professionals are joining in the cosmetic enhancement area of medicine without all of the professionalism the cosmetic surgeon has been educated. Sadly, these other medical professionals delve into questionable treatments such as liposuction in their offices, which they aren’t trained to do, whether it is the family doctor, dermatologist or internist. In the news we saw crazy stories about the Brazilian Butt lift case, where...

Rash of California Drownings – Protecting Your Family

Drowning victim On one side of the argument, people argue that global warming is causing the recent California heat wave. On the other side of the coin, others say that the climate is constantly changing and shifting. Whatever the cause of this recent heat wave in the Golden State, one this is clear. When it gets hot, the effect is that people take their kids and themselves to swimming pools and beaches. Not everyone is as experienced at floatation and swimming however, and the more people in bodies of water, the more potential there is of becoming submerged and being unable to breathe. If the victim is not rescued quickly, they can breathe in water and become asphyxiated. If the drowning victim does not die, he or she can be left with brain...

Hon. J. Gary Hastings Interview – Improving Civility in Plaintiff’s Bar With Inns of Court

His Honor, J. Gary Hastings Before I introduce Justice J. Gary Hastings, I am going to give you some depth and breadth into why this is such an important topic to me. On my journey to becoming a personal injury lawyer while attending the California State Bar Law Office Study Program, I worked in a warehouse, and also drove a car that only ran on three cylinders, with a lawn chair as the front seat. That car got to me to the law offices that I had worked in for free, or next to nothing for even the slightest opportunity to learn real world practice of the law. Getting taken seriously, or simply getting my foot in the door to get that opportunity, was next to impossible. Only pure tenacity, determination and luck got me my very first opportunities. At...
