Cruise Vessel Security and Safety Act Provides Guidelines
Under the 2010 Cruise Vessel Security and Safety Act (CVSSA), cruise lines are legally required to report rape and other criminal activities, including homicide, and kidnapping, among others, aboard their ships.
The CVSSA lays down the following reporting requirements for crime occurring on cruise ships:
- The vessel was US-owned, or the offense occurred within United States maritime jurisdiction.
- The crime occurs against a US national regardless of jurisdiction.
- The crime happens in the United States territorial sea.
- The crime occurred while departing from or arriving at a US port and was committed by or against a US resident.
Cruise lines must pay fines for violating the CVVSA guidelines.
Can I Sue a Cruise Ship for Sexual Assault?
The cruise lines are generally liable for rape incidents perpetrated by one of their crew members. However, since lawsuits against large corporations, especially cruise lines, are challenging, the rape victim must properly report and preserve evidence.
When a sexual assault occurs, the victim must immediately report it to a high-ranked crew member or police crew onboard. They should also seek medical attention immediately to preserve evidence.
